I found this program which I thought was going to help me with ALC you know, drinking and fight.

Speaker 4And then and then you found a program to get out of your house and get safety.

They all I needed was Medicaid to move in.
I moved in.
They started giving me donations like weekly.
I thought, you know, it was just strange.
Speaker 4You know, so it's a it's a resident Let me help me understand, Jen, because I know nothing about this.

Speaker 8Yeah, it's some type of residential program.
I thought it was for miss health.
Speaker 4And how did you find out about it?

Speaker 13Well, it's you know, it's hard to say, but it's There are several things that some of them are set up for mental health and substance use treatments.

Speaker 13Called general well being, which kind of sounds like if you don't have another place to live, you get a free place.
There's another one for housing and senior support.

They used to give us two hundred dollars a week, and they said that it came from the church.

Then they gave you two hundred dollars in spending money.
But what about like sleeping and showering and all of that?
Was that done at the program?

Speaker 4You got a house with meals and room or smokes and booze and whatever they wanted.

You could buy cigarettes and liquor and all that.

So, Jen, this Better Living program allowed you to live there.
They provided meals, and they gave you two hundred dollars a week that you could spend on anything.
And you said that there were people there buying drugs and alcohol.

And you know, they don't provide meals for you.
You have to provide your own meals, the only thing, you know, even if you're disabled and you can't get up and down the stairs and feedures though they don't care.
Because there was a guy named Anthony that was there and I took care of him most of the time because he couldn't get around.
Okay, they don't clean them and even like this guy, thats the one like today.

Speaker 8Of money off of our medicaid is what they're doing.

But here here's the rundown.
Here's basically, we get a caller who says that she was in this program and they were taking her Medicaid and it was called the Better Living program.
And she said she lived in one of the houses and everyone there smoked fentanyl right out in the open, or they drank and they were actually given spending money every week to spend anyway.
They wanted two hundred dollars a week.
So are you telling me, Jen, that people in this better Living program would get their two hundred dollars, go out and buy fentanyl and come back to the house and smoke it right out in the open, yes.

In new homes, they require the fan the minimum exhaust airflow must be a certain amount.
Some codes allow for lowest continuous exhaust rate if the fan runs permanently.
Speaker 5It doesn't say it has to, but if.
Speaker 4It runs permanently, there is a minimum CFM they require in multifamily or tightly built homes, whatever the hell that means.
With tighter envelopes, there is an increasing emphasis on indoor air quality amending, and some are wiring fans to run all the time.
Speaker 5But I see nothing that would require it.
Speaker 4It says here In fact, continuous operation is a recommendation and not part of the standard national codes like the IRC or the NEEC.
Speaker 5So you heard you got bum information.
Speaker 18Bro in municipalities like Denver and everything in California, most of Colorado.

Because I brought up a lot of information on rentals.

Speaker 10We've got all kinds of great people.

Speaker 15And then Tasha Dunbar that they both work for Denver real estate moguls.
They've been talking about how many people you guys have been saying off air, how many people are pulling out of this market with Reynolds purely because of all the changes?
Speaker 19Right, Yeah, we have a lot of owners that have called us and want to sell properties because they don't want to deal with all the new laws.
Speaker 10They just want to get out and Brad, you deal with You.
Speaker 4Give me an idea, Tasha, Tasha, give me an idea of one of the laws that would comes up a lot that people don't.
Speaker 5Want to deal with.
Speaker 19So Denver landlord licensing is one they just fiil.
The government push on that and.
Speaker 5Then and what is that all about?
What is it?
What do they require?
Speaker 19So they have to do an inspection and then if whatever doesn't pass, they have to fix that, and then they have to renew it every couple of years, and if they don't, there's haf de fines associated with that.
It's not necessarily a bad thing to have properties that are in good condition.
I think it's more the feel that the government control.
And then the next one would be the non renewal law that they just put in place.
Speaker 5Where talk about that.
What is that about?
Speaker 19Yeah, So if a tenant isn't a property and you know they pay their rent their quote unquote a good tenant, you have to renew to them.
And the only way to not renew to them would be under a certain you know, there's a certain stipulation you're selling the property of family members moving back into the property if they've been late on payments.
But the consistency with that is you have to serve a demand three times and if they fulfill the demand, then that's not even a qualifying factor.
So if I mean basically you're forced into renewing, and we have a lot of owners that don't see eye to eye with certain tenants.
We had one that put in over twenty thousand dollars of damage and.
Speaker 4Work for way way Wait, wait, is that wouldn't be a reason to get rid of a tenant if they damage the property, you still have to renew them.
Speaker 19Well, you have to send certain forms to them in order to do that.
So yes, there's just a lot of hoops to jump in order to do so.
Now you can't just say I don't want to renew to you and we'removing on.
Speaker 4Okay, Brad O'Brien, are you getting a lot of increase from landlords or would be landlords.
Speaker 20Well, the recent changes in law have made it really tough for landlords to get rid of tenants and whenever they're in court more often, and if they get in court, it's more expensive, so it's just tougher to be a mom and pop landlord.
Speaker 5Now yeah, and also.
Speaker 7It's you know, it just costs everybody.
You know, it's going to raise the cost of everything.
Speaker 5Well, of course, of course it is.
Speaker 4I mean, whenever the government gets involved, it's going to raise the cost.
Speaker 5Now, Tasha, I heard you talking.
Speaker 4About something else off air that I think was a really something about fees or costs and disclosures, and I think I was thinking we should be talking about this on the air.
Speaker 5Do you recall the discussion I'm talking about?
Speaker 21No, I don't.
Speaker 4Okay, Well, it was like maybe less than an hour ago.
I heard you talking off the air about having to advertise certain fees or there were ways that.
Speaker 21Yeah, sorry about that.
Speaker 19Yeah, So the new laws require you to have the fees very bold letter in your lease, so there's no weird fees associated with like hidden fees, which we've never done as a company, but there have been other property managers that have like admin fees and everything like that.
Speaker 5So now, yeah, Or you see.
Speaker 4A big sign outside of a big building saying, you know, two bedroom condos twelve ninety five, and then when you get in there you find out there's a whole bunch of other fees on top of that, making it more like sixteen or eighteen hundred bucks.
Speaker 19Correct, yep, So they've changed that, which again I don't think necessarily that some of these things are bad, but again yes, we're it's just creating a lot more work.
And then there's they did away with if you can't charge utility fees, so that this is a big one, is that if you have like we have an eight plex, so they're not on separate meters for water, they're not on separate meters for the boiler system.
So what thing have always done is separate per unit.
There's eight units in there, so we divide the whatever that bill is by a add it to the tenants leap port to pay with rent.
You can no longer do that anymore.
So no, no, So if it is not a separate meter, then you cannot charge the tune a fee for utilities any longer.
Speaker 21And the problem is, well, then.
Speaker 4How does a landlord collect for them then so or do they have to build it into the rent.
Speaker 21They have to build it into the rent.
Speaker 19The problem is though that they the laws take effect in the middle of the year, so we renew ninety percent of our leases in June, and now this takes a fit effect January one.
So we have owners that if the tunant aren't willing to sign a lease saying hey we're transitioning over to where it's a one rent payment, they're going to be out thousands of dollars for six months, and how we can then integrate that into their new lease.
Speaker 7These are all things that the government doesn't think about time when they pass these laws, or they don't care.
Speaker 4Okay, so Brad O'Brien, you know what she's talking about.
Right, So in other words, they can't divide up the utility bill.
You cannot charge utilities unless it's a separate meter.
That is an absolute law right now, or it's going it's going to be January first.
Speaker 20Yeah, this has this has to do with House Bill ten ninety that we talked about when I was in here about two months ago.
Yeah, where service providers now starting January first, have to in bold on the first page of their you know, advertisements or contracts, state here's what it's going to cost to you consumer in one number for this transaction.
So the for leases, I guess it's an annual number.
Speaker 5And so you can't have.
Speaker 20Utilities costs which change on a monthly basis.
You can't reduce that to one number for a year.
So the way to resolve that would be landlord just have to build that into the base leaves or have the tenants pay the utail to dress.
Speaker 4How would you even know?
How do you even know how to build it in?
That's what I want to know.
I mean, guys, you manage properties.
I mean, you're going to have to estimate high so you don't get burned.
If I'm a landlord and i have eight tenants and I'm not allowed to charge individually, I'm not allowed to divide it up.
I have to kind of estimate what I'm going to be paying in utilities, am I?
And just charge more rent.
That's the bottom line.
Speaker 21Right, Yeah, that's exactly it.
Speaker 19And then the problem is is that, yeah, there is no way, I mean, you can get an estimate, but there's also no incentive to the tenant to not leave their light on all day long.
Where before it was like we could send them and say, hey, the utility bill was this, you know, just keep an eye, or they got a bill that was like oh man, it went from fifty dollars to one hundred and fifty.
Speaker 21I need to try right off the lights.
Speaker 19But now, I mean there's no incentive for them to have any sponsibility.
Let's turn the acon and open up the window, you know.
Speaker 1And that water.
Speaker 5I bet water is a big part, a big thing.
Speaker 20It can run up the bill on correct, Yeah, more the electricity.
Speaker 5So wait a minute.
Speaker 4So so landlords to get around this would have to put in separate meters, is that right?
Speaker 21Correct?
Speaker 19So unless each unit has their own meter, which again I mean you're talking thousands and thousands of dollars to do that for especially some of these older places.
I mean, we have one that we're looking to take over that as a forty units in it, and the owner is like, I don't even know what to do with this.
Speaker 21I am losing.
Speaker 19And if the tenant won't voluntarily sign this addendum and their lease doesn't renew for another six months, eight months or whatever, you're out that money.
Speaker 4So so then once they renew, their rent is obviously going to go up because utilities will be included.
Speaker 5Correct.
Once a tenant.
Speaker 4Hears utilities included, they're going to run the hot water all day, or they're going to run the heat.
They're going to grow soap, or they're going to turn on the air conditioning and open the door they want, they don't care.
Are in fact, some landlords used to do it by square footage.
Speaker 19Yeah, yeah, we have all different formulas.
I mean we managed I think this is affected at least thirty of the properties that we manage, and so we had different formulas.
Speaker 21Yeah, some were on square footage.
Speaker 19If they were all the exact same square footage, all with like one occupant or something like that, it was by you know, just that.
So there's definitely different formulas, but all have been you know, fairly divided.
Speaker 4And for those listening, Brad, what's the name of this house bill?
Speaker 5They want to look it up.
Speaker 10It was House Bill twenty five, ten ninety.
Speaker 4And it's more than just affecting landlords, right, Brad, it's affecting any service provider or Yeah.
It's this transparent pricing basically what editions.
Speaker 14Apparently it applies to restaurants.
Speaker 5I don't know how, but if so, they're.
Speaker 4Not allowed to advertise unless the advertised price includes everything.
Speaker 10Right, and except for sales tax.
Speaker 20Yeah, and you can put some caveats, like you know, I guess suppose if you're a plumber, and you could say this is what I'm estimating for this job that you called me on.
If I find something different that's outside this scope, that'll be a separate charge.

But a landlord is screwed the landlords.
It sounds like guys landlords are really getting screwed by this bill.

So, Deputy d we tried to track down the Better Living program.

Speaker 13Yes, Tom, I did get in contact with First Priority Institutes for Better Living, which is the program that it sounds like Jen was enrolled in, and I spoke with a lady over there just a few minutes ago.
She said that our caller is completely mistaken because First Priority Institute for Better Living offers only online courses and online treatments, so they offer online di classes.
Speaker 4And she was living in had nothing to do with the Better Living program.
Speaker 13Said, First Priority Institute for Better Living does neither.
They neither operate, you know, residence programs, nor do they fund them, nor do they fund or have any contact.
Speaker 5With any You don't think like that.
Speaker 15Do you don't think she was fabricating actually living somewhere.

Speaker 13And also I looked up the address that she gave us.
It's a very nice single family of residence in Aurora.

So we contacted the Better Living Program.

Speaker 13The First Priority Institute for Better Living is an organization that offers online counseling only, and the three areas that they treat with DUI classes.
The second one is for ADHD and another one for autism.
I believe, and everything is done online.
They have no inpatient services and furthermore, they don't fund any such locations they and I believe them.
I mean, this woman had didn't sound like she was bsing me.
And by the way, everything she told me on the phone was confirmed by a quick visit to their website.
Speaker 4So here's what I want to know, Jen, Is it possible you were part of another program or the house you were living in the house you were living in was not Better Living, it was somewhere else.

Speaker 4What I say about here's what I say about pricing in general, there are companies that can do jobs cheaper and their one job away from bankruptcy, meaning that if they have a problem, they can't stand behind it.

Speaker 4But there is something else I say, and that is I don't believe.
I don't believe in price gouging either.
And I love the guaranteed lowest price.
I love when you have both, when you have the guaranteed lowest price and it does come from a company that can stand behind things like I advertise renew home innovations.
Okay, they give the guaranteed lowest price on furnaces and they will stand behind jobs, and they are big.

Speaker 4But I don't think that price is everything, Nor do I say that price indicates quality.

They made two more attempts to correct the problem, but the tubs were still white, and he was sent and he wanted he sent him back.

Go ahead, So the tub is supposed to be white on the inside and black on the app.

Speaker 15So while this is going on yesterday, Dmitri's working on it, I'm working on it.
I literally start looking at the that he sent us a picture of there's a five hundred pound tub sitting on his porch, no joke, still in the box.
So I'm looking at all the different numbers on the box and I start doing research and I look it up and no matter what I look at, it says that is a black.

Period to end a story.
Speaker 15So I actually email this guy some information and I ask him, I said, is this possible the apparent off white or creamy shade visible in the outside of your unboxed photos is most likely the plastic wrapping and other things under it.
Are you positive it's not black?
And he replies the caller Ryan, absolutely not.
Now why do I bring that up?

What did we find out?
Speaker 25Yeah, So what we found out is that indeed, if and like contractor didn't do it, nobody did it.
There's like five layers of wrapping.
There was clear wrapping.
There was a white blanket and all of this around it, and if you got through that, it is indeed outside it black.
Speaker 15And just out of curiosity when I sent you a very detailed email saying the reason it probably appears white is because of this.
You didn't even look yesterday.
What made you finally look.
Speaker 25What made me finally look is is I spoke to Dmitri again and he spoke with your buddy from Walmart, who said they've had this issue before.

It just spoils down to.

The guy said, okay, he would give his money back.
In fact, he claims he did give the money back.
He claims that he counted out the dollars.

Speaker 4Front of a deputy, and the deputy took the money and gave it back to the consumer.
He said the bodycam footage would clearly show this.
In fact, he went one step further and he said, if you look at the bodycam footage and I'm lying, you can ruin me and you can ruin my business.
Speaker 5Matthews the consumer.
Speaker 4We told Matthew and we told Anthony both.
Anthony is the vendor with I believe it's AMG Customs.
But they both claimed the body footage would vindicate them.
Okay, so what happened when you looked at the bodycam footage?

Here's what I want to know.
Who looked at it?
I didn't look at it.
Mark's not there.
Mark did look at it?
Did Mark look at it?

Speaker 22And so I can kind of give you a little bit of a recap.

Speaker 22Just a basic kind of stop in a parking lot and it looked like Matthew was parked off to the side and him and the two sheriff deputies were talking.
And then the second video was actually at Anthony Yorke's house, which is where he does business out of and they went up and tried to get him out of the house, knocked on the door a few times.
Eventually he did come out of the house.
They asked him about the thousand dollars.
Speaker 5Now, wait, you can hear that.

Speaker 22He asked him about the thousand dollars, and Anthony said he and Matthew had an agreement that he needed more time.
And at that point the sheriffs were kind of well, there's not much more we can do if he's saying that you had an agreement, blah blah blah.

Speaker 22No, thank you, said, he came out very briefly on his doorstep talk to the officer, said that he did not have the money and that him and Matthew had an agreement or from what And again this audio was very not great, but from what I could gather, they had an agreements according to Anthony, and that he needed more time.
