The Thanksgiving holiday travel rush is kicking into high gear today and tomorrow.

Those are expected to be the two busiest travel days along with Sunday.

About seven million people in southern California.

We're going to be traveling by road or by air, Triple A says.

Top destinations for the holiday weekend are San Diego, Las Vegas, the Bay Area, and Disneyland.

Two people have been taken into custody after an eight year old girl was hit by a stray bullet fired through the wall of her family's apartment in Delray neighborhood.

The girl was treated she's been released from the hospital.

The girl's parents told NBCLA they don't feel safe and don't want to live there anymore.

A candlelight vigil is planned for this evening to remember Alhambra police officer Alex Sanders.

He was killed when his patrol car crashed during a chase of a stolen SUV last Thursday.

The vigil's going to be at five point thirty outside the Alhambra Police Station.

The Pentagon's looking at a possible misconduct by former Navy pilot Arizona Senator Mark Kelly.

ABC's Karen Travers is going to join us in just a couple of minutes to tell us what he's done and what might happen moving forward.

The charges against former FBI Director James Comy and New York Attorney General Letitia James have been dismissed.

ABC Stephen Portnoy is going to help us sort it out.

Are they off the hook or new charges coming?

Who might prosecute the case?

Let's get started with some of the stories coming out of the KFI twenty four hour newsroom.

LA police are keeping quiet about the death of a teenage girl whose body was found in the trunk of singer David's Tesla in Hollywood.

Former LAPD detective Moses Castillo tells KTLA a judge is letting investigators keep the medical examiner's findings secret for now.

Which tells me that the findings are there.

They know the report is complete.

Speaker 1

The remains of Celestereebas were found in September, a day after she would have turned fifteen.

Singer David Burke is considered a suspect.

He canceled his concert tour after the discovery and also moved out of his rented home in the Hollywood Hills.

A man accused of leading police on a chase that ended with a crash that killed an al Hamburg police officer has been charged with two counts of murder.

A passenger in the suv allegedly driven by Steven Zapotta, was also killed in the crash on Thursday.

Upota is also charged with fleeing a peace officer and reckless driving.

Local and federal officials have held a hearing in La over federal immigration enforcement in the city.

The joint hearing in LA involved members of Congress and city and county elected officials.

The Democrats say they're looking into reports of violations by federal immigration agents.

Congressman Robert Garcia says in a video there's a new online dashboard to make reports of alleged violations.

The dashboard collects information about possible misconduct against not just immigrants, but also US citizens.

Garcias serves on the House Oversight Committee.

He was asked by La Mayor Bass to bring a federal hearing to this city.

Let's say good morning now to ABC's Karen Travers.

Karen Arizona Democratic Senator Mark Kelly is going to be reviewed by the Department of Defense.

Tell us what that means and what led up to it.

Speaker 7

Yeah, I mean, we had to see how this plays out in what exactly it looks like.

But that's what the Defense Department announced yesterday that it was launching eight thorough review, as they put it in Democratic Senator Mark Kelly, citing serious allegations of misconduct.

This, of course, comes after the President accused Kelly and other Democratic wilemakers of feditious behavior punishable by death for the video last week that they released in which they said that US service members could refuse illegal orders.

The White House said yesterday that they support the investigation.

Caroline Levitt said, all the Democrats in the video should be held accountable, but right now it is Mark Kelly specifically in this spotlight and being targeted with this thorough review, and he's not backing down.

I mean, he is very defiant, saying that this is an effort to intimidate him, but that it won't work and he will not be silenced.

Okay, And so Karen for the military, if he was investigated by military officials and they decided to charge him or something, does the military have its own set of rules or is it pretty much the same?

Speaker 3

Yeah?

Okay, yeah, they do.

So.

Officers who've retired after twenty years of service are able to be recalled to active duty, and if it's determined they've engaged in misconduct, they are subject to military prosecution, potentially a court martial.

Kelly had served for twenty five years in the Navy, and of course he was an astronaut, he was at NASA.

He retired in twenty eleven, so here you would be looking at the Uniform Code of Military Justice.

That's what the Pentagon cited yesterday.

Pete haig Seth wrote in his post that Kelly is as a retired Navy commander, is still subject to the UCMJ.

And as hag Seth put it, he knows that.

Speaker 1

So technically he is, but it just doesn't really happen that they would call them back to active duty, like you can do it, but it really doesn't happen.

Speaker 7

Right, This is incredibly surprising to see this happen and see this play out absolutely okay.

Speaker 1

And of that video that the Administration and the Pentagon is goin up in arms about.

Part of it is because they're saying, don't take illegal orders, but they can't point out any illegal orders that were actually given, and so they're basically saying they're inciting, inciting a crowd or leading people to do something.

Is that part of what the investigation and.

Speaker 7

That's yeah, that's what the White House is saying, that this is encouraging US service members to disobey the chain of command, and the lawmakers are saying they're specifically talking about unlawful orders.

The white House pushback.

Is that everything the president has done has been lawful, and so that this is inappropriate for these lawmakers to say, Okay.

Well, we'll be watching what our next steps will waite and see if they decide to pull them back in.

I think that is exactly right, because they are now doing the investigation.

All right, let's get back to some of the stories coming out of the KFI twenty four hour newsroom.

The White House circulating a proposal that would extend Obamacare subsidies for two more years.

They're said to expire at the end of the year.

Extending the subsidies it was one of the demands by Democrats during the government shutdown last month.

The White House has stressed that no plan is final until President Trump announces it.

The Trump administration reportedly plans to review the cases of all refugees led into the US during the Biden administration.

Nearly two hundred thousand people were allowed into the country during that time.

The AP says, according to a memo, expediency and quantity were prioritized during the Biden years over detailed screening and vetting, and that warrants a comprehensive review.

Democrats have lined up to take over the seat of a high profile Republican congressman in SOCOW.

So far, eleven Democrats are running to unsee Congressman darryl Isa from the San Diego area.

The new district lines in place thanks to Prop fifty cut right through the district, leaving him vulnerable of getting kicked out of office right now.

The Prop fifty maps are being disputed in court by the California GOP and the Department of Justice.

Last week, a judge blocked the redistricting effort in Texas to favor Republicans, saying those new maps in that state would harm black and Latino voters.

It's flu season and the chances of its spreading increased over the holidays.

Is people hug and shake hands?

Well, what else are they supposed to do?

Doctor Darien Sutton is among physicians warning about an influenza strain coming from the H three N two virus that's been circulating in other countries for months.

This new variant, which is called subclad K, appeared after flu vaccines were manufactured for the year.

That creates a problem called a mismatch.

Doctors say people should get vaccinated to reduce the chances of catching the flu and to lessen the effects of the illness if they get infected.

A woman in Thailand has shocked the staff at a Buddhist temple in Bangkok when she started moving.

It was right before her body wasposed to be cremated.

Officials say the sixty five year old woman's brother drove her three hundred miles to be cremated when there was a faint knock heard coming from the coffin.

Video shows the woman in the back of a pickup truck slightly moving her arms in head.

The brother said his sister had been bedridden for about two years.

Her health got worse and she became unresponsive and appeared to stop breathing two days earlier.

How about when you see his name on the ballot.

State election records show TV pitchman Vincent Shlomi as filed for an historically conservative district north of Austin, Texas that includes the area around Fort Hood.

Shlomi rose to fame for his infomercials where he sold both an absorbent towel and a kitchen tool called the slap Chop.

Shlomi is sixty one, and in two thousand and nine he was arrested for punching a prostitute in a Miami hotel room.

The La County Medical Examiner's Office is it can't release any more information about its investigation into the death and dismemberment of the teenager found in the trunk of a tesla owned by the singer David.

The LAPD got a court order to place the Medical Examiner's investigation under seal while detectives continued their investigation into Celesterevas's death.

Local labor leader David Huerta is expected to be arraigned today on a misdemeanor count of obstructing a federal officer at a June immigration enforcement raid on a garment industry works site in downtown La.

The SEIU president was originally charged with a felony, but prosecutors reduced that charge last month to a misdemeanor.

Powerball jackpot's getting up there the next drawing tomorrow night.

It's going to be worth an estimated six hundred and eighty one million dollars.

So, Stephen, criminal complaints against both former FBI Director James Camey and New York Attorney General Letitia James have been dismissed.

Tell us about the federal judges ruling.

Speaker 2

Well, this was a ruling yesterday by a federal judge in South Carolina, who was asked by two of her colleagues on the bench in Eastern Virginia to look at this question of Lindsay Halligan's appointment as acting US Attorney.

What the judge ruled yesterday is that it has nothing to do with how Lindsay Halligan has handled this case and everything to do with the calendar.

There's a law that says that in the case of vacancy in a US Attorney's office, the President in the attorney sorry, the Attorney General, can appoint a replacement for one hundred and twenty days, But after one hundred and twenty days without the Senate confirming someone for the post, the district court judges in a particular area are supposed to decide who should be the US Attorney.

And in the case of the Eastern District of Virginia, that clock started on January twentieth with President Trump's inauguration, and there was a man named Eric Siebert who was serving as acting US Attorney.

In fact, was the nominee for that post, backed by Virginia's two Democratic senators, but ultimately the President pushed him out in September because he was believed to be dragging his heels or actually rejecting the argument that cases should be brought against Comye and James.

So what I should say is that Eric Sebert was actually appointed by the judges of the Eastern District of Virginia after that twenty day clock ran out, but when he left in September.

Yesterday's ruling holds that the clock had stopped, and that it's up to the court, not the administration, to decide who should serve in that acting capacity.

So the idea that Lindsay Halligan could be installed by the executive branch runs a foul of the statute, which dates back to the nineteen sixties, according to the ruling yesterday.

Speaker 1

Okay, so quick question, was Halligan appointed earlier it ran out and then the new guy came in, or was Halligan appointed after he.

Speaker 2

Left, or both Halligan came in after the other guy was forced out.

So the idea is that you know the clock had run out, that it was up to the district court judges to decide who the US attorney should be, not the Attorney General.

And look, Pam Bondi says she's going to appeal this, and the reason is not just to preserve the cases against Letitia James and James call mey.

It's to preserve this idea that the law passed sixty years ago is unconstitutional.

Now that law has been relied on by federal courts increasingly because this administration and this Senate can't seem to get on the same page with appointing and confirming US attorneys.

So all across the country, most notably in New Jersey, you're a case where Alina Habba is the President's choice to be US attorney, but the judges there said no, no, no.

The statute says that after one hundred and twenty days, you can't get a Senate confirmed appointee.

We decide, and we decide it should be this other person.

And the administration says, no, no, no, you don't get to decide because you're the judicial branch and we're the executive branch, and this arrangement that Congress set up many decades ago should fall.

Okay, Well that's a big fight, yeah, and it has very little to do with how individual cases are handled, and everything to do with this sort of statutory you know, separation of powers scheme that has been that is contested.

Okay, So here's a question for you, Stephen, because you've followed this, and here's my take on this.

I think that Trump is used to being a businessman.

Now he's obviously he's switched roles, but he's used to hiring and firing people as he wants to, and so he's still trying to do that, but he can't because of the government machine and the way that things are set up.

Speaker 2

Does that mean, well, look, I mean this is a case that these are two cases involving Letitia James and allegations of mortgage fraud and James Comby in allegations that he led to Congress.

Both of these individuals say that they've been targeted by Donald Trump for being his political enemies.

And now you have this examination of the way the Justice Department has handled itself.

And the Justice Department can shrug this off and say it's a technicality, but you know, I think the headline in the Wall Street Journal editorial makes it pretty plain.

It's the way this could be viewed.

This is the gang that canon dt straight.

I mean, there's a way to do this.

There's a proper way to do it.

By the way, in the case of James, call me not only was he FBI director.

He was also Deputy Attorney General of the United States and representing him as a former US attorney and special counsel Patrick Fitzgerald.

These are people who know how to win in court.

And the question is is that legal firepower outmatched when it comes to As the Wall Street Journal puts it, the gang that can in dit straight.

A cammeblelit vigil as planned for this evening to remember Alhambra police officer Alec Sanders.

He was killed when his patrol car crashed during a chase of a stolen suv last Thursday.

The vigil is going to be at five point thirty outside the Alhambra Police station.

The suv driver, whose passenger was also killed in the crashes, facing murder charges.

Anaheim Police are still looking for a hit and run driver who crashed into a twelve year old boy on an e bike.

Police Sergeant Matt Sutters is a boy in the car collided Sunday night.

The car then crashed about a block away and the driver and passengers ran off, the boys recovering in the hospital.

The holiday rush is on.

Nearly six point eight million Southern Californians are expected to hit the road or the skies for Thanksgiving.

Triple A says ninety percent of travelers are going to be driving today through Monday.

This afternoon and tomorrow afternoon are going to be the busiest on the road.

Waste Triple A is recommending you leave before ten or eleven to avoid the worst of the traffic.

A judge has tossed crime charges against former FBI director James Comy and New York's Attorney General Letitia James.

But is it over?

Okay, let's talk tech and Google is making a run at Nvidia.

Yeah, this is really interesting.

I mean, you know that Nvidia has really been the AI tech darling of all time, right, It's like.

Speaker 1

The most valuable stock.

Speaker 8

People have made trillions of dollars on this thing, and we never think about them really having major competition.

But now meta platforms Facebook parent rights in talks to spend billions on Google's AIS, these tensor processing units or TPUs.

This would establish TPUs as an alternative to in videos chips, so in video shares are under pressure.

It would be a big win for Google, but still depends on whether these tensor chips can really demonstrate the power efficiency and the computing muscle will say necessary to be a viable option.

We'll see they better be powerful if they're charging, if they're going after in video retail sales, we actually just got that report that sales were up just a little bit in September after three months of strong sales.

I'm yessing that's the big tame on Wall Street today.

Speaker 2

It is.

And the thing is, you know, sometimes bad news is good news on Wall Street, and stock futures are mixed.

But as for those retails, bad news is good news on Wall Street sometimes because if the news is bad, it means, you know, the Fed's more likely to cut interest rates.

Right, But this report, it's not great news.

Not adjusted for inflation, retail purchases gained only two tents of percent after those bigger games you mentioned for the previous months, and excluding cars and gasales rows only.

One tenth of a percent.

So you got to think about it.

Prices are going up, but people are spending less So that's like a double whammy showing a weakening economy right going into the holiday shopping season.

So you know people are going to be out there looking for bargains Black Friday.

That's for sure.

I will be okay.

So your credit score a very important thing when it comes to buying houses and cars and all that stuff, and somebody wants to hurt our credit scores.

Well, that's what some.

Of the analysts are saying.

I mean, this is from Bill Pulti, head of the Finance Housing Finance Agency.

He's been you know, a lot of people have not been too happy with a lot of his ideas lately.

The fifty year mortgage got panned.

He's trying now, the Federal Housing Finance Agency, also known as FIFA, is going to start backing loans scored by Vantage Score solutions as an alternative to FIGHTO.

The idea is to bring.

Speaker 8

More competition to the home loan market.

And the idea is when you have more competition, prices will go down for consumers and consumers would pay less for the all the credit checks that go into home buying.

But analysts say that prices will likely rise for consumers in spite of the introduction of this competition.

So it's another thumbs down for Bill Polty idea.

The TSA says it's greened over two and a half million travelers each day over the weekend, and they expect that number to top three million in the coming days.

There were more than forty nine hundred flight delays and two hundred and sixty cancelations in the US Yesterday.

Four more people have been arrested in connection with the Crown jewel heist at the Louver.

Prosecutors say two men and two women from Paris have been taken into custody.

The jewels, that included diamond and emerald necklace Napoleon gave to Empress Marie Louise and are valued at more than one hundred million dollars not been recovered.

The Pentagon says is going to review allegations of misconduct by Arizona Senator Mark Kelly.

The retired Navy captain could be recalled the active duty for cart martial proceedings, or administrative measures, as they're called.

The review follows Kelly's involvement in a social media post telling members of the military that they must ignore illegal orders from the president, but didn't say what those illegal orders might have been.

It was very cool because it said you can only return this for three hundred and sixty five days.

I thought that that was very cool, almost as good as Costco.

So I told listeners while we were waiting and trying to find you that we really need to be careful about return policies as we go out and start throwing our money out on Black Friday.

Speaker 3

Yes, oh my goodness, you're going to be drawn to the sales they have already started.

They are insane and intense, and there are some good deals to be had out there.

I want to remind people it's not a great deal if you don't need the item, right, Like fifty percent off is awesome, but like, do you actually need it?

Then can you actually afford it?

It's really important to remember.

And then also, well can you return it if it turns out that's not something that the person you love in your life actually wants, or like, just make sure you keep the gift receipt and make sure you know the return policy for each retailer, because there's, yeah, there's there have been some changes for some retailers this year, and so you just want to make sure you're up to speed on each retailer.

And you know that's why shopping from certain retailers like Truly Somebody, like shopping from Costco, you just know that you're going to have a very generous or term policy on every idem of electronics for like ninety days, and then everything else is kind of like a hey, bring it back whenever, And that's just kind of some nice peace of mind.

So even if you spend just a tiny bit more, it might be worth it to get a better return policy, Joel, are there.

Any companies that you know of specifically that have really bad return policies that we should really be watching out for.

Speaker 3

You know, I think more than anything, you want to be careful with small retailers online they might have and specifically we've seen this a lot with more clothing retailers, a lot of final sale items, and those final sales when it says that it typically means you can't return this at all.

It doesn't matter it didn't fit, you didn't like it, it was a little misshapen.

It's like nope, sorry, Like this is yours for good.

So, especially if you're buying a final sale item online, be really careful to deal might be spectacular, but if it doesn't work out for you, like you're just out the money, then you're probably donating that to good will or giving it to a friend or something like that, because hoping that they can get some use out of it.

So definitely watch out for final sale items and know with some of those smaller retailers, you might have a really crummy return policy.

And if you're doing shopping in advance, the clock starts ticking right on that return policy.

The closer you buy to Christmas, hey, you might have some a decent window on the back side, but the earlier you buy your item, then you know you might not have much time after was to make that return.

Well, I thought about that because actually I found something for one of my friends.

I don't know if you guys have had this happen, but I got to get this and then you go, oh, what if they don't like it?

And you've bought it three months in advance knowing that there's just a thirty day return policy.

So I didn't buy it, and now I've forgotten what it was and it was going to be a great present.

See that's the downside of pre planning, right, is that then the return policy can flap you around a little bit.

Okay, so just be very weary and even on Amazon, be leery of it.

Because I've bought a few things on Amazon and then went to return them they're like, oh, this is ineligible, so when you're buying it, check for the return policy.

Speaker 3

That's exactly right, especially I mean food products on Amazon.

Of course understandably you can't return those at all.

And there might be exceptions, right, you might be able to bark up the tree of customer service and offer an explanation, but who wants to do that?

So just know in advance, Hey, what does the short term policy?

Look it up?

And sometimes for a lot of retailers there are special holiday return policies.

We'll give you through January fifteen, door through you know, if they're bought in let's say after November fifteenth.

So just yeah, it can change for the holidays.

Just know what you're getting into.

Make sure that's something that's as you're buying gifts on your mind.

Okay, And then real quick, let's talk about nostalgia buying for the holidays.

Speaker 3

Oh so this is an interesting one, and we're seeing kind of people unders like I don't know, like saying, what was it from my childhood that is resonating now?

And even like the kids toys and stuff like the Ninja Turtles are back in Super Mario and stuff, and those were toys for my kids for my day and age, and now my son is into that same stuff.

Legos are huge, and it's just it's it's interesting to see people buying and spending more sometimes for nostalgic goods and even buying used goods because it means that's the only way they can get the item they want.

So certain items like apparently old school Lulu Lemon leggings like from a decade plus ago are in again, and so people are like spending big money on Pasha and thread Up and these these secondary sales sites where you're getting used closed but you're not spending use closed prices.

People are classifying them as like vintage leggings and stuff like that.

So I did not know that workout gear could eventually be considered vintage.

That actually seems kind of ridiculous, like given what you do in your workout gear.

Yeah yeah, but this is a thing and people are into it, and so yeah, it's if you love those leggings and that's something you're really into, more power to you just know that.

Like the way people are going to sell those items and market those items, it's it's going to make it seem like it's this fleeting thing.

You've got to get it now.

It's these vintage leggings, and I think people are going to pay too much for some of their nostalgia hopes and dreams.

Supply and demand, right, that's right, and just marketing man make people think that this is a limited time item, because hey, there aren't many of these left, and you're going to be able to get people to cork over more.

Money for it because most of them are all thanky and they've been thrown out.

That's exactly right.

There really is the limited supply.
