By the time the transfer actually occurred, the shares had plummeted in value by over 90%, resulting in an inflated tax windfall for the donor.

This case highlights that a charitable gift is only legally recognized when the recipient gains full control of the property, not when a donor promises a future transfer.

Ultimately, the foundation's failure to follow strict valuation rules and its history of minimal philanthropic activity led to its revocation. This story serves as a stern warning for Canadian charities to verify the physical receipt of assets before documenting their worth for tax purposes.
